Recently, an article was released at the Daily Mail in which the top graduating student from the ZIALE thanked Dr. Rajan Mahtani for his significant contribution to the educational society.

The award was launched in the year 2012 by Finance Bank Zambia whose chairman is Dr. Rajan Lekhraj Mahtani. This award was launched for honouring memory and legacy of late Steven Mwaba Malama, who does in the year 2012. Steven Malama was a notable legal architect of Zambia and was esteemed member of the bar. Steven Malama has been described as distinguished law professional, Bar luminary and role model for many in the legal society. He was also a good friend of Dr. Rajan Mahtani and to honour his contributions to the society, this award was established. The award is presented to the top graduating student from ZIALE (Zambia Institute of Advanced Legal Education). ZIALE is one of the top law colleges in Zambia and the award goes to students qualifying for Bar admission in their first attempt.

Emmanuel Bwalya Kaluba won the award for the year 2018-19. To share his gratitude, an article was penned down by Emmanuel which thanked Dr. Rajan Mahtani for his significant contribution to the legal students. Apart from the prestigious award which in itself is a distinguished achievement, the winning student will also receive a certificate, a plaque as well as an award money worth K15,000. The award has been established as a long-term opportunity for students and is presented at the yearly Gala Dinner for LAZ. Despite the various difficulties and challenges, Dr. Rajan Mahtani continues to work for the development and betterment of the Zambian society and its people.

Press Release Statement Against Unethical And Unlawful Social Media Post

Dr. Rajan Mahtani’s name was recently a topic of negative reputation campaign. While such negative reputation campaigns or defamatory posts are common for Dr. Rajan Mahtani, this one was different. Normally, Dr. Rajan Mahtani receives such defamatory posts from jealous or vengeful entities as well as those who have not been able to persuade Dr. Rajan Mahtani to engage with unethical and illegal business practices. However, this case was different as the allegation came from Miriam Mwanawasa, daughter of late ex-President of Zambia Levy Mwanawasa. It should be noted here that Levy Mwanawasa and Dr. Rajan Mahtani have maintained a long-standing, transparent professional as well as personal relationship with each other. This relationship was smooth even after the sad demise of the late ex-Zambian president.

As a result, it was an extremely shocking news when it was found that Miriam Mwanawasa shared a Facebook post claiming that Dr. Rajan Mahtani had intentions of taking control of the farmland at Masaiti. This farmland is owned by the Mwanawasa family. This Facebook post, due to its nature and the person sharing it, started making round across the web. As a result, it came under the scanner of Dr. Rajan Mahtani and his legal team decided to take appropriate actions against this act.

Dr. Rajan Mahtani released a press statement shortly after. In this press statement, Dr. Rajan Mahtani clarified that he never made any claims of taking control of the farmland. Neither he made any statement with the Mwanawasa family not he had any intentions. Dr. Rajan Mahtani himself iterated that he had a great personal and professional relationship with the late ex-President of Zambia. As a result, it was extremely defamatory, malicious and scandalous for daughter Miriam Mwanawasa to share such content across online media platform. Furthermore, the press statement also clarified that the Facebook post was shared without giving any other form of evidence. As such, the authenticity of the post was questionable from the start.

Furthermore, Dr. Rajan Mahtani also said that he will be taking strict actions against this act as it resulted in significant loss of reputation for Dr. Rajan Mahtani.

It seems like Dr. Rajan Lekhraj Mahtani is always fighting one thing or the other. A Facebook post recently caught the attention of Dr. Rajan Mahtani as it had made claims that were ludicrous and baseless. More so, the claims came from Miriam Mwanawasa, who is the daughter of late Zambian president Levy Mwanawasa. It is no secret that Dr. Rajan Mahtani shared a personal and professional relationship with the president for a long time. As a result, such malicious claims coming from the daughter was truly shocking. In her Facebook post, Miriam Mwanawasa claimed that Dr. Mahtani allegedly wanted to inherit the farm owned by the Mwanawasa family at the Masaiti district. But the truth is, Dr. Rajan Mahtani never made such requests anytime and the post was made without any basis. It is yet unclear why the daughter of the late ex-President resorted to such act but Dr. Rajan Mahtani was in no way letting this negative reputation damage his status.

As such, Dr. Rajan Lekhraj Mahtani immediately released a press statement in which he claimed that all allegations made by Miriam Mwanawasa were baseless and fake. In his final verdict, justice Mwinde on behalf of the higher Court of Appeal announced that Dr. Rajan Mahtani was indeed the actual owner of the Portland Cement Zambia based on the evidences.

Dr. Rajan Mahtani Gets Back Portland Cement Ownership With Patience And Perseverance

Dr. Rajan Mahtani’s journey from Lusaka High Court to higher Court of Appeal has been full of ups and downs. This journey was taken for Portland Cement Zambia, a cement-manufacturing factory which was unethically taken over. The case was initially registered at the Lusaka High Court with a positive hope that the judge will provide quick decision considering the availability of critical evidences and facts. However, more than a decade passed and despite the long and stretched case proceedings, Dr. Rajan Mahtani did not receive justice. In the year 2017, final verdict on the case was announced by judge Nkonde on behalf of the Lusaka High Court. This decision was highly controversial as it announced Ventriglia family as the only shareholders of the Portland Cement Zambia factory, despite the obvious lack of evidences and testimonials from their end.

Dr. Rajan Mahtani quickly identified the challenges of this court and took the decision of approaching higher Court of Appeal. The case was chaired by Justice Mwinde and the case proceedings were quick. The final decision from the higher Court of Appeal was announced on 31st January 2019, around nine months after the case was registered at the higher Court of Appeal. According to the evidentiary support, justice Mwinde confirmed transfer of one billion kwachas from Dr. Rajan Mahtani owned Finsbury Investments to the Portland Cement Zambia limited. Furthermore, the excerpts from the original agreement between shareholders established in the year 2007 also confirmed that Dr. Mahtani owned 58 percent shares at the factory and has completed all monetary transactions associated with the exchange. As such, he is not liable for any further bills or dues associated with the factory.

Based on the identified evidences, the judge from the higher Court of Appeal confirmed that Dr. Rajan Lekhraj Mahtani is the actual owner and majority shareholder of the Portland Cement Zambia factory. The decision from higher Court of Appeal on this case is final and the case is now effectively closed.

After A Decade Of Wait, Dr. Rajan Mahtani Announced Winner Of The Portland Cement Zambia Case

According to this decision, Dr. Rajan Mahtani owned Finsbury Investments holds 58 percent shares at the factory and are the majority shareholders of the Zambezi Portland Cement. On the other hand, Ventriglias owned Ital Terrazzo Limited holds just 42 percent shares at the factory and are the minority shareholders without any legal ownership over the factory. This decision from the Court of Appeal aligned with the original shareholders agreement established in the year 2007. Therefore, the decision from the Court of Appeal clearly establishes the fact that Dr. Rajan Mahtani is the legal owner of the Portland Cement Zambia factory.

While giving this decision, Justice Mwinde from the Court of Appeal also said that the judge below him was wrong in declaring Ventriglias as only shareholders of the Zambezi Portland as this decision was misdirected and without any evidence. Furthermore, a timeline of three months from the date of the judgement has been given during which all share sales and regulations related activities must be completed.

Portland Cement Zambia is a noted factory that was not for highest production of cement, once upon a time. Now it is just a destitute factory with negligent care & maintenance and almost negligible product. This negative transition can be attributed to the Ventriglias, who took over the factory from Dr. Rajan Mahtani illegally. Since then, Dr. Rajan Mahtani is fighting a case at the Lusaka High Court for legal ownership over the factory.

The Portland Cement Zambia is legally owned by Dr. Rajan Mahtani. During his leadership and before the illegal takeover, the factory was one of the largest producers of cement in Zambia. Portland Cement Zambia was also one of the favourite employers for the people in the province. Even people from far-away places came to work at the factory with the hope of better salary and better life. The factory production was in excess and the revenues were high. This also improved the salary and compensation structure and the workers received regular bonuses and salary hikes. However, the condition of the factory has turned upside down since the illegal capture by the Ventriglias. The goons have looted all the cash from the factory cash box. Workers have either left due to non-payment of finances or are still working with very low salaries and wages. The assets are also ill-maintained leading to low production. Experts suggest that if the factory is not revived now, it will be very late for Portland Cement Zambia.

Dr. Rajan Mahtani is currently fighting the case at the Lusaka High Court. As per the latest announcement made by the judge handling this case, case hearing is closed. This means no more hearing will be done and both parties will be submitting their evidences in written and oral format. After looking into the evidences, the judge will make the final judgment soon.

This case stretched for over nine years and during this time, the condition of the factory deteriorated. This can be attributed to the negligence by Ventriglias, who are presently controlling the factory. The case was launched after Dr. Mahtani claimed that the factory was illegally taken over by the Ventriglias. At the same time, the Ventriglias counter-claimed that the shared that Dr. Mahtani owned in Zambezi Portland were not paid for.
