Present Hakainde Hichilema to completely abolish the death penalty law

The President of Zambia, Hakainde Hichilema, was recently applauded for his recent announcement. On the occasion of the Africa Day, Zambian President announced that he plans to abolish the death penalty row completely. This announcement has been met with significant positive response. Dr. Rajan Lekhraj Mahtani, a noted businessman and philanthropist from Zambia, has also supported this decision. Dr. Mahtani owned Prison Fellowship Zambia is a noted Christian Outreach Program. Prison Fellowship has three major missions. The first mission is to bring the teachings of Almighty Jesus Christ to the prisoners, ex-prisoners and their families in Zambia. The second mission is to ensure transparent criminal justice for the inmates, ex-inmates and their families in Zambia. The third major mission is ensuring that the prisoners are not devoid of fundamental human rights and basic human dignity. As such, Dr. Rajan Mahtani has stated that his organization Prison Fellowship will provide all legal and regulatory support to ensure that this announcement by the Zambian President turns into a reality.

There is a growing consensus towards abolishing death penalty across the globe as well as across Zambia. The last death penalty execution in Zambia was given in the year 1997 by President Frederick Chilruba. Since then, Presidents across Zambia have been avoiding the death penalty or death warrant by using mercy prerogatives. As such, the announcement by the Zambian President is a step in the right direction. This is all the more significant considering the several initiatives undertaken by the Zambian Government for strategically decongesting the prisons in Zambia. The Zambian Government has collaborated with institutes such as Parole Board Zambia and Zambian Correctional Facility for strategically releasing prisoners after their complete transformation and integration within the society. Dr. Rajan Lekhraj Mahtani has supported this move by stating that he had the chance of visiting prisons across Zambia and saw several transformations over time, with prisoners completely dedicated towards service of God. As such, abolishing death penalty is a step in the right direction for Zambia and Zambian Law.

Ventriglias challenge the decision from the higher Court of Appeal, rejected by Supreme Court

According to the latest decision from the Supreme Court Zambia, Dr. Rajan Mahtani is the legal owner of the Portland Cement Zambia factory. The case of Portland Cement Zambia is peculiar as it has been approached to almost all levels of judiciary system in Zambia. Portland Cement Zambia factory was established in the year 2004 and in 2006, a series of verified and legal shareholding changes made Dr. Rajan Mahtani owned Finsbury Investments as the majority shareholder and legal owner of the factory.

However, things took a tumultuous turn when the Ventriglias took over the factory via unethical means. This promoted Dr. Rajan Mahtani to approach the Lusaka High Court. The judge at the Lusaka High Court was justice Nkonde and despite sharing all relevant evidences and testimonials, the judge gave a controversial decision in which the Ventriglias were announced as only shareholders of the Portland Cement. However, Dr. Rajan Mahtani was quick to approach the higher Court of Appeal and after around nine months of case proceedings, justice Mwinde on behalf of the Court of Appeal announced his decision on 31st January 2019. According to this decision, Dr. Rajan Mahtani owned Finsbury Investments is the majority shareholder and legal owner of the factory with 58 percent shared and Ventriglias owned Ital Terrazzo Limited holds juts 42 percent shares over the factory without any legal ownership. The decision also confirmed that the actual amount to be paid by Finsbury Investments against the majority shares owned is K580,000 and not K580 million.

However, it seems like the Ventriglias decided to try their luck one more time by approaching the higher Court of Appeal. In their appeal, the Ventriglias challenged the decision from the higher Court of Appeal. A bench comprising of three judges was established by the Supreme Court of Zambia for reviewing the validity of the appeal. After the review, the appeal was rejected on legal grounds and circumstantial evidences. As such, Dr. Rajan Mahtani remains the only owner of the Portland Cement factory.

Ownership Of Portland Cement Zambia Given Back To Dr. Mahtani, Court Of Appeal Confirms Case

For the past decade, Dr. Rajan Lekhraj Mahtani fought for the legal takeover of the Portland Cement Zambia factory. The battle started when Dr. Rajan Mahtani initially registered a case at the Lusaka High Court after claiming that his factory was illegally taken over from him. Despite sharing numerous evidences and testimonials, the final justice from the Lusaka High Court was controversial and Dr. Rajan Mahtani was taken aback. The judge at the Lusaka High Court was justice Mwinde and according to his final decision, Ventriglias were the only shareholders of the Zambezi Portland Cement. This decision was misdirected and to counter this decision, Dr. Rajan Mahtani took the case to the Court of Appeal.

The Court of Appeal is one of the highest legal and judiciary systems in Zambia. The judge at the Court of Appeal was justice Mwinde who gave the final decision on the Portland Cement Zambia case on 31st January 2019. According to this decision, Dr. Rajan Mahtani owned Finsbury Investments holds 58 percent shares at the factory and are the majority shareholders of the Zambezi Portland Cement. On the other hand, Ventriglias owned Ital Terrazzo Limited holds just 42 percent shares at the factory and are the minority shareholders without any legal ownership over the factory. This decision from the Court of Appeal aligned with the original shareholders agreement established in the year 2007. Therefore, the decision from the Court of Appeal clearly establishes the fact that Dr. Rajan Mahtani is the legal owner of the Portland Cement Zambia factory.

While giving this decision, Justice Mwinde from the Court of Appeal also said that the judge below him was wrong in declaring Ventriglias as only shareholders of the Zambezi Portland as this decision was misdirected and without any evidence. Furthermore, a timeline of three months from the date of the judgement has been given during which all share sales and regulations related activities must be completed.

Dr. Rajan Lekhraj Mahtani was finally given the majority shareholding and legal ownership status for his company Portland Cement Zambia. This decision was announced at the Court of Appeal on 31st January 2019. On this day, the judge at the Court of Appeal announced that Dr. Rajan Mahtani is the majority shareholder of the Zambezi Portland Cement factory as he holds 58 percent shares at the factory. On the other hand, it was also announced that Ventriglias hold just 42 percent shares at the factory and are the minority shareholder without any legal ownership over the factory. This decision aligned with the original shareholders agreement which was established in the year 2006. Furthermore, the judge from the Court of Appeal also said that the judgement given by the Lusaka High Court judge was misdirected and against the interests of the public policies. It should be noted here that Dr. Rajan Mahtani had initially registered the case at the Lusaka High Court almost a decade back. As a result of the various incompetency of the court, the case delayed for more than ten years. Even after that, the final judgement was against Dr. Rajan Mahtani’s claims wherein it was announced that Ventriglias were only shareholders of the Zambezi Portland Cement. This prompted Dr. Mahtani to take firm step and approach the Court of Appeal for further justice.

As of now, the decision from the Court of Appeal is final and cannot be changed at any circumstances. All forgery related allegations have also been discarded by the Court of Appeal judge. In a further statement, the Court of Appeal stated that all parties are required to proceed with regularization of the sales of the shares, taking effect from December 2006 and aligning with the Shareholders Agreement established by the Court in the month of January 2019. The Judge provided a timeline of three months for completing this share regularization process.

Unjustified Judgment At The Lusaka High Court Locked Down, Dr. Mahtani Wins Back Portland Cement

A historical judgement was established on 31st January 2019 when the Court of Appeal at Zambia declared the results for Zambezi Portland Cement. In this judgment, the recently given judgement on the cement factory at the Lusaka High Court was reversed effectively. The original case of Zambezi Portland was registered by Dr. Rajan Mahtani, a noted businessman and entrepreneur in Zambia. Dr. Rajan Mahtani is known for his numerous successful ventures across Zambia and foreign locations such as United Kingdom. He is also known for his charitable activities and philanthropic works. After the factory was illegally taken over by the Ventriglias, a case was registered at the Lusaka High Court. However, judgement came too late and too little. Justice Nkonde at the Lusaka High Court gave judgment against Dr. Rajan Mahtani despite all evidences stating otherwise. This led to Dr. Mahtani registering another appeal at the Higher Court of Appeal.

The judgement at the Court of Appeal was delivered by Justice Mwinde which effectively reversed the judgement at the Lusaka High Court which held Ventriglias to be only shareholders of the Zambezi Portland Cement. Justice Mwinde also iterated that the justice below him, Justice Nkonde was wrong in declaring Ventriglias as only shareholders when there was not enough evidence to support this judgement. As per the new judgement at Court of Appeal, Finsbury Investments is the majority shareholder of Zambezi Portland Cement with 58 percent shares and the Ventriglias hold 42 percent shares at the factory. This gives Dr. Mahtani owned Finsbury Investments Power of Attorney over the factory. This final judgment is also in line with the original shareholders agreement which was established in the year 2007.

As per the latest agreement, Finsbury Investment has paid a sum of K580, 000, 000 for commercial registration with interest as per the compliance. As such, the court has provided a timeline of three months for both parties to re-establish the shareholding patterns as per the new judgment.

The Supreme Court Zambia Judge Mumba Malila recently gave a testimony before the court which clearly indicates that Zambia is in dire need of policies and practices that would help in eradicating corruption and unethical practices that have crippled the nation like a plague. In his testimony, Justice Mumba Malila opened about a case of Dr. Rajan Mahtani, a noted businessman and philanthropist in Zambia with more than thirty years of business experience. The case in the said testimony was in 2012 related to Dr. Mahtani in which the final judgement was given against him. However, the testimony from the judge states that the judgement was plagues by external forces and the case was against the interests of the public policies. The judge who was the Attorney General during that time along with others tried to make the case ‘null and void’ due to its irrelevant nature, but the tribunal did not change its decision and the final judgement was given against Dr. Rajan Mahtani, even though the evidences and facts presented denoted otherwise. It is high time for the Zambian government and the law makers to take actions against these widespread corrupt practices and improve the condition of the nation so that there is room for further development and growth for the people.
