Higher Court Of Appeal Plays Significant Role In Giving Justice To Dr. Rajan Mahtani

One of the most successful businessman in Zambia, Dr. Rajan Lekhraj Mahtani, has faced significant challenges his entire life. These challenges are associated with dealing with corrupt officials, unethical practices and ensuring transparency in his business practices. However, one of the biggest challenges which Dr. Mahtani has faced over the years has been to gain back ownership of the Portland Cement Zambia factory after it was unethically and illegally taken over from him. For more than a decade, Dr. Rajan Mahtani fought tirelessly at the Lusaka High Court with the sole purpose of getting back Portland Cement ownership and saving the factory from its downfall at the hands of its capturer. However, transparent and straightforward businessmen are often the ones facing the highest challenges. Dr. Rajan Mahtani was not given justice at the Lusaka High Court justice Nkonde on behalf of the court announced that Ventriglias were only shareholders of the Portland Cement.

Dr. Rajan Mahtani has always been a believer of the country’s judiciary system and despite this outright misdirected decision from the Lusaka High Court, Dr. Rajan Mahtani decided to take another chance and approached the higher Court of Appeal. The judge at the higher Court of Appeal was justice Mwinde who, unlike the previous judge, made a thorough observation of the evidences and testimonials. It should be noted here that the final decision from the higher Court of Appeal came on 31st January 2019 which was just nine months of case proceedings. In his final verdict, justice Mwinde on behalf of the higher Court of Appeal announced that Dr. Rajan Mahtani was indeed the actual owner of the Portland Cement Zambia based on the evidences.

It is said that those who follow a path of transparency and ethics, are the ones reaping the rewards at the end. In this case, it was Dr. Rajan Lekhraj Mahtani reaping the reward for his transparency and ethical stance.

Final Results From Court Of Appeal Gives Hope To Dr. Mahtani, Wins Long-Pending Case

Just like any developing nation within the African subcontinent, Zambia has also its share of numerous ups and down. While the nation has shown development from several fronts, it is also facing several difficulties especially in the area of corruption and unethical practices. Even the government institutions such as courts and legal systems are unable to escape this mess. The example of Dr. Rajan Mahtani and the case of Portland Cement Zambia is a prime example. Dr. Rajan Mahtani is a respected businessman which several successful ventures in Zambia and outside. His companies like Finsbury Investments and Mahtani Group of Companies have received significant success and are known for their ethical and transparent business practices. In a similar manner, Dr. Rajan Mahtani built the Portland Cement Zambia, a cement-manufacturing factory.

This cement factory was unethically taken over from him. After this, Dr. Rajan Mahtani approached the Court of Appeal where the case went for more than a decade without final decision. Despite this, Dr. Rajan Mahtani was not given justice as the judge at the Lusaka High Court announced that Ventriglias were only shareholders of the Portland Cement Zambia. After this, Dr. Rajan Mahtani was left with no option but to approach the Court of Appeal and rightly so. The Court of Appeal lived up to its expectations and on 31st January 2019, the final results for the case were declared. This was just nine months after Dr. Rajan Mahtani re-appealed. The judge at the Court of Appeal was justice Mwinde and he gave the final decision only after looking into all evidences and testimonials. According to this decision, Finsbury Investments holds 58 percent shares at the factory and Ital Terrazzo Limited holds 42 percent shares at the factory. Finsbury Investments is a company owned by Dr. Rajan Mahtani and the Ventriglias hold accountability for the entity Ital Terrazzo Limited.

From this decision from the Court of Appeal, it is clear that Dr. Rajan Mahtani is the only owner of the Portland Cement Zambia factory.

Dr. Rajan Mahtani Unhappy with Court Verdict, Moves to Higher Court

The case of Portland Cement Zambia famous across entire Zambia. The cement factory was running under the leadership of Dr. Rajan Mahtani for a long time. Dr. Mahtani is a noted businessman, entrepreneur and philanthropist. He is also known for his charitable activities, though he does not like to publicize his charity works or other philanthropic activities. Dr. Rajan Mahtani started the Portland Cement Zambia factory and quickly took it into the top position, making the cement factory higher producer of cement across the nation. The factory was also known for providing higher than industry average wages and salaries to its employees, staff and workers. However, Dr. Rajan Mahtani is currently fighting for the legal takeover of the factory.

The case was launched almost a decade back at the Lusaka High Court. After the initial trial, there were various roadblocks that resulted in long-stretch of the case proceedings. Sometimes the judge got transferred and other time the parties were not present. The latest judge handling this case made a progressive announcement few months back when he declared that the case hearing was closed and no more trials will be conducted. He also asked both parties to submit their evidences and based on these evidences; the final judgement was expected soon.

Expert opinion suggested an easy win for Dr. Rajan Mahtani as his evidences were much stronger than the respondents. However, the final verdict was announced few weeks ago and it was shocking for everyone, including the general public. As per the judge’s verdict, Dr. Rajan Mahtani lost the case and the ownership was snatched away from him. However, Dr. Rajan Mahtani is not bogged down by this verdict. It is well known that the verdict and the judgment with the High Court judge is biased and not based on the evidences provided. As such, Dr. Rajan Mahtani has now approached the higher court of appeal at Zambia to file a motion against the judgement made at the Lusaka High Court.
